Welcome to e-language ("the Service"). These Terms and Conditions govern your use of the e-language website, application, and services located at https://e-language.et/ and any associated applications or platforms (collectively "e-language").

By accessing or using e-language, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our Service.

In these Terms and Conditions: "Service" refers to the e-language platform and all related services. "User," "you," or "your" refers to individuals or entities accessing or using the Service. "We," "us," or "our" refers to the owners and operators of e-language. "Content" refers to text, audio, video, translations, graphics, and other materials that may be available through the Service.

3.1. Account Registration: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3. Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms and Conditions or is harmful to other users, us, or third parties, or for any other reason.

4.1. Permitted Use: You may use e-language solely for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Service: a) In any way that violates applicable laws or regulations. b) To transmit or facilitate the transmission of any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. c) To impersonate or attempt to impersonate another person or entity. d) To engage in any activity that interferes with or disrupts the Service. e) To attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.

4.2. Translation and Language Services: e-language provides translation and language-related services. While we strive for accuracy, we cannot guarantee that all translations or language services will be error-free or suitable for specific purposes.

4.3. Service Modifications: We reserve the right to modify or discontinue, temporarily or permanently, the Service or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of the Service or any part thereof.

5.1. Content Ownership: You retain ownership rights to any content you submit, post, or display on or through the Service. By submitting content to e-language, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Service.

5.2. Content Responsibility: You are solely responsible for any content you submit to the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to submit such content.

5.3. Content Removal: We reserve the right, but not the obligation, to review, monitor, or remove any content that we determine, in our sole discretion, violates these Terms and Conditions or is otherwise objectionable.

5.4. User Engagement and Performance Tracking: We track user engagement metrics including course completion, quiz performance, time spent on the platform, and other interaction data. This information is used to improve the Service and to determine eligibility for prizes and rewards as described in Section 9.

6.1. Service Ownership: The Service and its original content, features, and functionality are owned by e-language and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal or internal business purposes.

6.3. Restrictions: You may not: a) Modify, adapt, or hack the Service or modify another website so as to falsely imply that it is associated with the Service. b) Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us. c) Use any automated means, including but not limited to agents, robots, scripts, or spiders, to access, monitor, or copy any part of the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. Please review our Privacy Policy at https://e-language.et/privacy for information on how we collect, use, and share your information.

8.1. Service Fee: The basic service fee for e-language is 3 Birr daily. This fee provides access to all standard features of the platform including language courses, quizzes, and eligibility for prizes and rewards.

8.2. Billing and Collection: The daily service fee will be collected through your selected payment method. You authorize us to charge your payment method on a recurring daily basis until you cancel your subscription or we terminate it.

8.3. Payment Methods: We accept various payment methods as specified on the Service. You agree to provide accurate and complete billing information, including name, address, telephone number, and valid payment method information.

8.4. Non-payment: Failure to maintain a valid payment method or sufficient funds for the service fee may result in suspension or termination of your access to the Service.

8.5. Price Changes: We reserve the right to change our prices at any time. If we change the service fee, we will provide notice of the change on the Service or via email at least 30 days before the change takes effect.

To promote active participation on the platform, users may earn rewards based on the number of courses successfully completed within defined evaluation periods.

Daily Rewards: a) The top 20 users, ranked by the highest number of courses completed in a single day, will each receive ETB 100 airtime.

Weekly Rewards: a) The top 3 users, ranked by the highest number of courses completed within a calendar week, will each receive ETB 5,000 e-money.

Monthly Rewards: a) The top 2 users, ranked by the highest number of courses completed within a calendar month, will each receive one smartphone. b) The top 1 user, ranked by the highest number of courses completed within the same calendar month, will receive one personal computer (PC).

Evaluation & General Terms: a) Course completion and user ranking are determined automatically by the platform system. b) Only successfully completed courses are counted toward rankings. c) In the event of a tie, ranking will be determined by the earliest course completion time. d) Rewards are granted per evaluation period (daily, weekly, monthly) and are not cumulative unless explicitly stated. e) Airtime and e-money rewards will be credited to the registered mobile number or wallet associated with the user account. f) Physical prizes are subject to availability and may be replaced with items of equal value at the operator's discretion. g) Rewards are non-transferable and not redeemable for cash. h) The service provider and telecom operator reserve the right to modify, suspend, or terminate the reward program in accordance with applicable regulations.

10.1. Termination by You: You may terminate your account at any time by following the instructions on the service or by contacting us.

10.2. Termination by Us: We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms and Conditions.

10.3. Effect of Termination: Upon termination, your right to use the service will immediately cease. All provisions of these Terms and Conditions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.1. Service Provided "As Is": The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2. Accuracy and Reliability: We do not warrant that the service will be error-free, uninterrupted, or secure or that defects will be corrected. We make no representations about the accuracy, reliability, completeness, or timeliness of the Service or any content therein.

11.3. Translation Accuracy: While we strive to provide accurate translations and language services, we cannot guarantee perfect accuracy or suitability for specific purposes, including legal, medical, or other specialized contexts.

11.4. Reward Program: While we make every effort to award prizes as described, we do not guarantee the availability of specific prizes. We reserve the right to substitute prizes of equal or greater value if necessary. Prize eligibility is subject to compliance with these Terms and Conditions.

12.1. Exclusion of Damages: In no event shall we be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, arising from or relating to your use of the Service, even if we have been advised of the possibility of such damages.

12.2. Limitation of Liability: Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action will at all times be limited to the amount paid, if any, by you to us for the service during the 12 months prior to the claim.

You agree to defend, indemnify, and hold harmless e-language and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Service.

14.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to its conflict of law provisions.

14.2. Dispute Resolution: Any dispute arising from or relating to these Terms and Conditions or the Service shall be resolved through binding arbitration in Addis Ababa, Ethiopia, in accordance with the rules of the Ethiopian Arbitration and Conciliation Center.

14.3. Class Action Waiver: You agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and you waive your right to have any dispute heard as a class action, representative action, or consolidated action.

We reserve the right to modify these Terms and Conditions at any time. If we make material changes, we will provide notice through the service or via email. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms and Conditions.

16.1. Entire Agreement: These Terms and Conditions constitute the entire agreement between you and e-language regarding the Service and supersede all prior agreements and understandings.

16.2. Waiver: Our failure to enforce any right or provision of these Terms and Conditions shall not be considered a waiver of such right or provision.

16.3. Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

16.4. Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including but not limited to natural disasters, civil or military disturbances, acts of terrorism, or internet failures.

17.1. XP Definition: Experience Points (XP) are virtual points earned by users through various learning activities on the e-language platform. XP serves as a measure of user engagement and learning progress.

17.2. How to Earn XP: Users can earn XP through the following activities: (a) Completing a lesson: 5 XP per lesson completed; (b) Completing a quiz: 10 XP per quiz completed; (c) Completing a full course: 15 XP upon course completion; (d) Daily check-in: 5 XP for logging into the platform daily.

17.3. XP Rules and Conditions: XP is awarded automatically upon completion of eligible activities. XP cannot be purchased, transferred, or exchanged for monetary value. XP has no cash value and cannot be redeemed for any products or services outside the platform.

17.4. Leaderboard System: The leaderboard displays user rankings based on accumulated XP. Rankings are updated in real-time as users earn XP. Only active, non-suspended, and non-banned users appear on the leaderboard.

17.5. Fair Play Policy: Users who engage in fraudulent activities to artificially increase XP (such as creating multiple accounts, using automated systems, or exploiting system vulnerabilities) will have their XP reset and may face account suspension or termination.

17.6. XP Modification: We reserve the right to modify, suspend, or discontinue the XP system at any time without prior notice. We may adjust XP values for different activities or reset user XP in cases of system maintenance or policy violations.

17.7. Privacy and Leaderboards: User privacy is maintained on leaderboards by partially hiding usernames (showing only first 4 and last 2 characters with asterisks in between). Full names are never displayed publicly on leaderboards.
